OUTFRONT Snapchat Kiosk — Photo Release & Terms of Use

Before you use this kiosk, please note: this is a photo release. By tapping I Agree, you confirm that you are 18 or older and authorize OUTFRONT, Warner Bros. Discovery, and their affiliates and partners to use your photo, name, and likeness in advertising on public screens (including in Times Square) and online and in other promotional media worldwide without compensation. You also waive related image, privacy, and publicity rights. Display of your photo is not guaranteed – we may decline to show any image, including for inappropriate attire or behavior. The full terms of use are set out below.
OUTFRONT Media LLC ("OUTFRONT") operates this kiosk for the HBO Max House of the Dragon Season 3 premier event (the "Event"). The kiosk captures a photo of you with a Snapchat-powered augmented-reality effect (your "Photo"). OUTFRONT and its agents may also photograph and record the Event, including attendees interacting with the kiosk ("Event Footage"). Your Photo and any Event Footage in which you appear are together the "Content." By tapping I AGREE, you accept these terms.
1. Eligibility
You must be 18 or older to use the kiosk. If anyone under 18 appears in any Content with you, you confirm you are that person's parent or legal guardian and give this consent and release on their behalf.
2. How the Content may be used
You allow OUTFRONT, Warner Bros. Discovery, and their respective affiliates, agencies, partners, licensees, successors, and assigns (collectively, the "Released Parties") to use the Content as follows:
- Display on OUTFRONT digital screens in and around Times Square.
- Display on other digital out-of-home screens in the New York City area in connection with the Event.
- Use for other advertising, publicity, marketing, and promotional purposes, including social media, paid media, websites, case studies, portfolios, award submissions, and press.
3. License and release
You grant the Released Parties an irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable license to capture, copy, store, edit, moderate, transmit, display, and otherwise use the Content, your name and likeness, and any derivative materials. You will receive no compensation.
You release the Released Parties from any and all claims arising out of those uses, including under New York Civil Rights Law §§ 50, 51, and 50-f and any equivalent law.
4. What appears with you
You are responsible for everything that appears with you in any Content, including clothing, signs, logos, props, and other people. You confirm you have all rights and consents necessary for anything and anyone appearing with you, and that the Content will not infringe any rights or violate any law.
5. Moderation
OUTFRONT may decline to display, remove, or stop using any Content in its sole discretion and without notice, for any reason, including if the Content is blurry, appears to depict an unaccompanied minor, contains inappropriate material, or does not meet OUTFRONT's or any host venue's standards. Nothing in these terms requires OUTFRONT to display or use any Content.
6. Disclaimers and liability cap
THE KIOSK IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, AND THEIR TOTAL AGGREGATE LIABILITY ARISING OUT OF THE KIOSK, THE CONTENT, THE EVENT, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
7. Indemnification
You will defend, indemnify, and hold harmless the Released Parties from any third-party claim arising out of your breach of these terms, anything or anyone appearing with you in any Content, or your violation of any law or third party's rights.
8. Electronic signature; record of agreement
Your tap on AGREE is your electronic signature and written consent under the federal E-SIGN Act (15 U.S.C. § 7001 et seq.), the New York Electronic Signatures and Records Act (N.Y. State Tech. Law Art. III), New York Civil Rights Law §§ 50, 51, and 50-f, and any equivalent law. OUTFRONT may retain an electronic record of your assent linked to your Photo and the version of these terms displayed.
9. Governing law and jury waiver
These terms are governed by New York law, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts in New York County, New York. YOU AND OUTFRONT EACH WAIVE ANY RIGHT TO A TRIAL BY JURY.
